ALPINISTAS ADVENTURES LLC

US Programs — Terms & Conditions

(Updated September 2026)

Alpinistas Adventures, LLC (“Alpinistas,” “we,” or “us”) offers guided outdoor programs and adventure travel services within the United States (“Programs”). The Programs are offered to you (“Client”) conditioned on your acceptance, without modification, of the terms, conditions, and notices contained here (the “Terms”). Your booking of any Alpinistas Program constitutes your agreement to all Terms. Please read them carefully and keep a copy for your reference.

These US Programs Terms apply to Programs operated within the United States. International trips, expeditions, and destination programs are governed by the separate International Travel, Programs and Expedition Terms & Conditions. Your use of the Alpinistas website is separately governed by the Website Terms & Conditions.

Scope of Services

Alpinistas provides guided backpacking, camping, hiking, and day-tour services, and instructional clinics in hiking, backpacking, camping, and related outdoor skills, within the United States. Alpinistas’ guides are hiking and backpacking guides. The Services are limited to those described in the applicable Program materials; any activity not described in those materials is outside the scope of Alpinistas’ Services and is undertaken at the Client’s own risk.

Release & Assumption of Risk

Client acknowledges that participating in a Program involves inherent risks. By participating in any Alpinistas Program, you agree to do so voluntarily and at your own risk, assume all risk of injury to yourself, and agree to release Alpinistas Adventures, LLC and any supporting third parties from any and all claims or causes of action, known or unknown, to the fullest extent permitted by law.

Client agrees to sign a separate waiver, release, and assumption-of-risk form in advance of participating in any Program. Participation is conditioned on delivery of that signed form.

Program Leader

1.     The Alpinistas guide or event leader assigned to a Program (the “Program Leader”) holds a standard of safety training and understanding of outdoor safety procedures consistent with Alpinistas leader requirements.

2.     The Program Leader is responsible for determining the logistics and equipment required for the Program, including activities, choice of camps, route, pace, and support personnel. The Program Leader may assist clients directly or delegate assistance to a third-party guide service or support. The Client is responsible for following the Program Leader’s instructions and procedures for the duration of the Program, and for alerting the Program Leader if any instruction is unclear. The Program Leader, or a third party the Program Leader delegates, may modify, shorten, or terminate the Program at any time in the interest of safety.

3.     Except where portering is a contracted part of the Program under the paragraph below, the Program Leader and third-party guides or support are not responsible for carrying a Client’s personal equipment. If the Program Leader or a third party carries a Client’s equipment on an incidental or emergency basis because the Client is unable to carry it, that carrying does not create liability for the Client’s equipment.

4.     Porter service. Where a Program includes porter service as a contracted, paid component, Alpinistas or its contracted porters will carry the Client gear described in the Program materials, subject to any weight, size, and packing limits stated there. Porters carry outdoor gear only. The Client must keep all valuables, including cash, electronics, identification, documents, and similar items, on their person and must not place them in portered gear; Alpinistas is not responsible for any valuables placed in portered gear. Alpinistas is not responsible for items the Client was instructed not to include, or for ordinary wear, and Alpinistas’ liability for loss of or damage to portered gear is subject to the limitation of liability in these Terms. The Client remains responsible for carrying essential safety items the Program materials direct the Client to keep on their person.

The Program

5.     The Client understands that a Program may take place in remote wilderness areas with hostile environments, including changes in terrain, temperature, and weather. Dangers and medical problems may arise. Alpinistas is not responsible for these conditions or for any stress they cause.

6.     The Client understands that Programs generally require a level of fitness and mobility to participate. The Client certifies they have no known mental or physical limitation, or pregnancy, that would create a hazard or limit the enjoyment of the trip for themselves, other clients, or staff. Alpinistas may decline participation for safety reasons; a refusal is treated as a cancellation governed by the Refund Policy. The Client certifies they have reviewed their health with a medical professional before joining.

7.     The Client acknowledges that Programs may take place in areas remote from medical care. The Client accepts the risks, dangers, and limited availability of medical care associated with such travel and, together with the limitations of liability in these Terms and in the signed waiver, releases Alpinistas from liability for such risks and for any failure to provide medical care.

Permits, Trip Dates, and Itinerary

Permit-dependent trips. Many Alpinistas Programs operate in Yosemite National Park and on other public lands that require permits issued through competitive lottery and reservation systems administered by the National Park Service and Recreation.gov. For those Programs, the availability of any specific date, trailhead, or route is subject to securing the required permit. Other Programs, including certain day tours, clinics, and local outings, may not be permit-gated; the provisions below apply to the extent a Program depends on a permit.

  • Date windows and confirmation. For trips offered by date window or priority booking, Alpinistas confirms specific trip dates after the applicable permit is secured. Dates are not guaranteed at the time of booking and may be assigned or adjusted based on permit availability.

  • Route and trailhead substitution. Alpinistas may substitute trailheads, routes, or itinerary elements as required by permit availability, conditions, or the guide’s safety authority, without reducing the Program fee. The published itinerary is anticipated and subject to the final trip plan.

  • Guide substitution. Alpinistas may substitute a qualified guide at any time.

Modifications made under this section are not a cancellation and do not entitle the Client to a refund, except as provided in the Refund Policy.

Changes and Cancellation by Alpinistas

Alpinistas reserves the right to change or cancel any Program at any time. Reasons may include natural disasters, weather, wildfire or smoke, permit or access changes, or inadequate enrollment.

  • If Alpinistas cancels a Program before it begins due to weather, natural events, or access or permit reasons, we will attempt to reschedule, or will issue a credit toward another Program of your choosing.

  • If Alpinistas cancels a Program partway through due to weather or similar conditions, a partial credit will be offered based on the portion of the Program not delivered.

  • Programs run subject to a minimum number of participants. We reserve the right to cancel for insufficient enrollment, communicated on or before your final payment date. If a Program is canceled for insufficient enrollment, you will be refunded all payments made, less a 6% transaction fee, or you may apply your payments to a future Program.

  • Because of the minimum-enrollment requirement, we recommend you not book non-refundable travel until your Program is confirmed. Alpinistas is not responsible for personal expenses incurred due to Program changes or cancellations.

  • Many Programs are based in wilderness settings where inclement or challenging weather is a normal variable. Alpinistas does not cancel Programs for ordinary challenging weather, as this is a normal part of mountain travel. Clients should monitor conditions and prepare their travel accordingly.

We strongly recommend purchasing travel insurance to protect your Program purchase against unforeseeable circumstances.

Force Majeure

Neither party is liable for failure or delay caused by events beyond its reasonable control, including wildfire, smoke or hazardous air quality, flood, storm, earthquake, natural disaster, epidemic or pandemic, government or National Park Service closure, road closure, permit suspension, or civil unrest (a “Force Majeure Event”). If a Force Majeure Event prevents a Program or any portion of it, the parties will first attempt to reschedule. If rescheduling is not feasible, Alpinistas will issue a credit for the portion of the Program not delivered, less non-recoverable costs already incurred (including non-refundable permit fees and committed guide compensation). Alpinistas is not responsible for any resulting personal expenses.

Travel Arrangements

]The Client is solely responsible for arranging and paying for all travel to and from the location where the Program begins.

]Where lodging or shared accommodation is part of a Program, arrangements are based on shared occupancy unless the Program specifies otherwise. Clients are responsible for the safety and security of their personal belongings in shared lodging. Refer to the Program FAQ regarding any single-occupancy option.

]No refunds or credits are granted outside the Refund Policy for failure to attend, late arrival, leaving early, or any inability to complete the Program, including for reasons of illness, injury, weather, or work or family obligations. Any costs caused by late arrival are at the Client’s expense.

]Carriage by road, air, or sea is subject to the individual carrier’s conditions.

Reseller and Third-Party Operated Trips

At times Alpinistas acts as a reseller of trips operated by a third party, in which case the third party’s terms and conditions apply in addition to these Terms, and the Client agrees to comply with both. Separately, Alpinistas may supply guide services for trips marketed or operated under another organization’s brand (including group, partner, and white-label arrangements); those engagements are governed by the separate written agreement between Alpinistas and the contracting organization.

Miscellaneous Program Terms

Drug use is not tolerated during any Program. Alcohol consumption must be responsible and may be prohibited during portions of a Program.

Alpinistas and third parties will make reasonable efforts to accommodate dietary restrictions, medical conditions, allergies, and other needs. The Client must notify Alpinistas in writing in advance. Such requests do not form part of the Program contract, and Alpinistas is not liable for failing to provide an accommodation.

Any guidance or advice provided by Alpinistas or a third party, including on climate, gear, apparel, or training, is a courtesy. Alpinistas is not responsible for any error or omission in that information.

The Refund and Cancellation Policy is incorporated into these Terms by reference and available on the Alpinistas website. Trip credit issued for a prior cancellation may be applied to future Alpinistas offerings, is not eligible for cash refund under any circumstances, is valid for 24 months from the date of issue, and may be transferred to another participant with prior written approval.

Photography & Video

By attending an Alpinistas Program, you grant Alpinistas a non-exclusive, royalty-free license to use images, photos, and video in which you appear for the promotion of Alpinistas and its Programs, across marketing and social channels, for a period of three (3) years from the date captured. Alpinistas will not sell or license your likeness to unrelated third parties for their own advertising. If you prefer not to appear in marketing, notify your guide or email us before the Program and we will make reasonable efforts to honor that request.

General Terms

Liquidated Amounts

The deposit and cancellation amounts set out in the Refund Policy reflect Alpinistas’ reservation of guides, dates, and permits, and the difficulty of reselling a reserved place. The parties agree these are reasonable estimates of Alpinistas’ loss and are agreed liquidated amounts, not penalties.

Indemnification

You agree to indemnify, defend, and hold harmless Alpinistas, its officers, directors, members, employees, guides, agents, and contractors from any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your participation in or inability to participate in a Program, your violation of these Terms, your violation of any rights of a third party, or your violation of any applicable law. Alpinistas may, at its own cost, assume the exclusive defense of any matter subject to indemnification by you, and you will cooperate in asserting available defenses.

Arbitration

If the parties cannot resolve a dispute arising out of or concerning these Terms — whether in contract, tort, or otherwise — the dispute will be resolved only by final and binding arbitration under the Federal Arbitration Act, before a single neutral arbitrator administered by the American Arbitration Association (or a similar service the parties select), held in Reno, Nevada. The arbitrator’s award is final and may be entered in any court of competent jurisdiction. The prevailing party is entitled to recover its costs and reasonable attorneys’ fees. The parties agree to arbitrate all disputes and claims relating to these Terms, including tort claims. The Federal Arbitration Act governs the interpretation and enforcement of this provision, and the arbitrator determines the scope and enforceability of this provision. This provision survives termination of these Terms.

Class Action Waiver

Any arbitration will proceed on an individual basis. Class arbitrations and class, representative, or collective actions are not permitted. THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. Unless both you and Alpinistas agree otherwise, the arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPINISTAS AND ITS SUPPLIERS ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE OR PROFITS OR PERSONAL INJURY, ARISING OUT OF OR CONNECTED WITH PARTICIPATION IN A PROGRAM OR USE OF RELATED SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF DAMAGES. IN NO EVENT WILL ALPINISTAS’ TOTAL LIABILITY UNDER ANY CLAIM EXCEED THE TOTAL FEES PAID BY THE CLIENT FOR THE BOOKED PROGRAM. BECAUSE SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, PORTIONS OF THIS LIMITATION MAY NOT APPLY TO YOU.

Governing Law; Venue

Alpinistas Adventures LLC is a Nevada limited liability company. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Nevada, without regard to conflict-of-laws rules, and you consent to the exclusive jurisdiction and venue of the courts located in Reno, Nevada for any matter not subject to arbitration. The Client acknowledges that Programs operate on a variety of lands — including federally managed public lands (such as National Park Service and U.S. Forest Service lands), state, regional, county, and municipal parks and public lands, and private lands — and are subject to the regulations, permit conditions, and authorities of the agency or owner managing the land where a given Program takes place. Nothing in these Terms limits the application of federal, state, or local law on those lands. If any provision is held invalid or unenforceable, it will be replaced by a valid provision that most closely matches its intent, and the remainder will continue in effect. No joint venture, partnership, employment, or agency relationship is created by this agreement.

Entire Agreement; Changes

Together with the Refund Policy and any signed waiver, these Terms are the entire agreement between you and Alpinistas regarding US Programs and supersede all prior communications and proposals. Where a separate signed agreement governs a booking (such as a group, partner, or white-label engagement), that agreement controls; on any matter it does not address, these Terms apply. Alpinistas may change these Terms at its discretion; the most current version supersedes all previous versions. These Terms are written in English.
